Lawyer: Immunity could force testimony from Beatty

Attorney says if Wayne Co. Prosecutor Kym Worthy provides protection, she would talk.

Ron French / The Detroit News

The best way to ensure that Christine Beatty testifies against her former boss and paramour would be to offer her immunity from prosecution, Beatty's lawyer said Thursday.

But no talks with Wayne County Prosecutor Kym Worthy are under way, said defense attorney Mayer Morganroth. "I'm not saying (Worthy) should" offer immunity, said defense attorney Mayer  Morganroth.

"I'm saying that if the prosecutor's office wants to settle the case, they know how to do it. They could offer immunity and then (Beatty) would be forced to testify."

Morganroth was responding to a Thursday story in The Detroit News reporting that Beatty's minister and a member of her ex-husband's family were encouraging the 37-year-old to make a plea deal.

Beatty faces multiple charges of perjury and obstruction of justice stemming from text messages that conflict with denials under oath that she and Kilpatrick fired a police officer and had an affair. If convicted, Beatty faces up to 15 years in prison.

"People can say whatever they want, but they don't know the facts and they don't know the law," Morganroth said.

"There are no negotiations. I've never been approached. They can grant immunity if they want -- it's up to them."

Although there has been much chatter about plea deals, it's the first time Morganroth has suggested publicly that immunity was a potential way for Beatty to extract herself from her legal mess.

If she were granted immunity, Beatty could no longer be prosecuted and could be compelled to testify against Kilpatrick.

"They know how to do it if they want," Morganroth said.

"And it's not by calling the press."

Worthy last week said in a published interview that her "door was open" to Beatty.

Now, Morganroth is intimating a specific legal structure.

Morganroth said it's up to Worthy to contact him if the prosecutor wants to make a deal. "I'm not going to stalk Kym Worthy," he said.

But Worthy countered that it's up to Morganroth to call the prosecutor's office if he wants to talk about a plea.

"Christine Beatty is Mr. Morganroth's client," Worthy said in a written response Thursday to Morganroth's comments.

"If he wants to discuss a plea negotiation on her behalf, all he needs to do is call. It's not up to me to call; we have a very strong case and we are ready to proceed."

    Awesome!

Defense always calls Prosecutor. Immunity is always asked for, depends on exactly how much Beatty knows. She'd have to agree to the contract fixing (plus a couple other Fed areas yet to come) plus the State charges. If they find out later, through investigation that she wasn't forthcoming with all information, the deal goes buh bye.

Does anyone know if any congressman/woman from the state of MI is unable to carry out their term, does their spouse, if they are married, automatically take over?
    ABSOLUTELY NOT.

Depends on the seat. Lt. Gov. for Gov. Some will be appointed by the Govenor (depending on timetable for elections), some elections are held immediately.

You're referencing J. Conyers seat? New election. It's a federal seat - House of Representatives, our Governor would not get involved, per se.

Let me clarify something I said.

Defense doesn't always go to Prosecutors. Sometimes Prosecutors will approach Defense depending on the circumstances. Prosecutors, because of their power, have to be very careful about bringing charges against someone with the hope they will become witnesses. That is blatant Prosecutorial Misconduct. Very Bad.

    Karmanos Finally Speaks....

    Fron the Freep:

    Karmanos: Kilpatrick should not resign

By KATHERINE YUNG • FREE PRESS BUSINESS WRITER • May 16, 2008

Detroit business leader Peter Karmanos Jr. said today that he does not think Mayor Kwame Kilpatrick should resign.

“He certainly should not resign because he’s the best we have,” the chairman and chief executive of Compuware Corp. told the Free Press during a company celebration this morning in downtown Detroit’s Campus Martius.

Karmanos declined to comment further. Karmanos agreed to move his company headquarters downtown in 1999, before Kilpatrick took office, and the new building is a hub of activity adjacent to Campus Martius Park.

Karmanos’ comments came just days after the Detroit City Council voted to launch two separate initiatives to try to oust the mayor, who is facing perjury and other charges related to the text message scandal.

Since the mayoral scandal broke, few of the city’s business leaders have been willing to publicly say anything about what the mayor should do. The board of Detroit Renaissance, a group of about 50 corporate chief executives in the region, is divided over whether it should take a stand on the controversy or continue to keep a low profile.

Karmanos has played a key role in efforts to revitalize Detroit, but he said that his work in this area has not been impeded by the mayoral text message scandal.

And a great comment from the freep forum:

She should ask for a new identity and get out of town. Far, far away.

We can look at this scenario from another perspective (Not that I would do this, lol!):

Kwame Kilpatrick has a weakness:  BECOMING EXPOSED

Kilpatrick has clearly shown that he will pay top dollar to cover up his wrongdoings, even if it isn't his own money. Christine Beatty KNOWS a lot!! She knows enough to put Kwame away for a long time. The same people or organizations paying for Kwame Kilpatrick's defense also has plenty of  hush money for Christine Beatty and her legal defense expenditures.

Yes, Morganroth will play that blackmail card to get paid, just like Mike Stefani got paid. Instead of agreeing to not turn over text messages as in the case of Stefani; Christine Beatty will agree to not testify against Kwame. Of course the agreement will be verbal  and payment will be made to a bank in the Cayman Islands.

Kwame gets off and reunites with Christine later!!

Carlita hooks up with one of the EPU guys.

Yes, this is a soap opera!

I wonder if the author of this article had the gumption to ask Karmanos how long he'd keep an employee who's done HALF the things Fat Boy has. Probably not. And one also has to wonder if the citizens of our fair town have figured out that Peter Karmanos has just insulted every last one of them by saying of Kwame Kilpatrick, "he's the best we have."

Looks like MotownJohnnie said it all. Pox on Karmanos.

Willing to bet, the Karmanos name will surface in the text messages. Interesting coincidence after yesterday's electronic information "policy change", which is legally null and void. These people are complete idiots, and now they’re complete and desperate idiots.

    Karmanos: Kilpatrick should not resign

Definitely in panic mode. Their mouths are moving much faster than their brains, without thinking about long term consequences of them. But then, when did any of them worry about consequences?

Makes me wonder though, what's going on in the background that is setting this off? Something, something big. Unless it's starting to become real - the shock has worn off.

Do you think we should take this seriously or is Morganroth just testing the waters? Sending a warning to the Kwame camp? Cough up the cash or we spill the beans. (Sorry for the imagery... I just couldn't resist.)

DON'T GIVE THEM ANY IDEAS!!!!!!! :-)
