Boomer - Here's my quandary.
This request of our Governor is unprecedented. There is no case law. They'll basically be making it up as they go (not really, but you know what I'm saying.)
Any decision will be appealed to the State Supreme Court. We have no idea how The Court will interpret the proceedings, as from what I understand they are not defined clearly. I think that it should be explored, even with opinion, what this proceeding actually is.
I agree, it is unprecedented and will likely be appealed. But, as I've stated in posts days ago, the supreme court may decide to let the governor's ruling stand (whatever it may be). Because this case is unprecedented, I think they'll need more help with 'interpretation', than anything else. At any rate, Jenny's got some serious homework to do.
